Zellwood Residents: Do We Need to Pursue This?

On February 5, 2021, FDEP issued a Notice of Intent to Issue a wastewater permit authorizing Shelley’s to continue to operate their Biosolids Treatment Facility (BTF). The public and other stakeholders have the opportunity to provide input by petitioning FDEP for an administrative hearing within 14 days of the Notice. Rules for petitioning can be found online. A time extension to file a petition may also be requested. Either request should be made directly through the Department of Environmental Protection’s Office of General Counsel. The mailing address is 3900 Commonwealth Blvd., Mail Station 35, Tallahassee, FL 32399-3000, or via electronic correspondence at Agency_Clerk@dep.state.fl.us followed by a mailed copy of the petition.

Via Maria Repass of Orange County's Environmental Protection Department Orange County Government is responding to complaints concerning objectionable odors in the Zellwood, Mt. Dora, and Tangerine areas and providing updates as new information becomes available. Working together on this complex issue, Orange County and the Florida Department of Environmental Protection (FDEP) are streamlining complaint processes, investigating odor concerns, providing compliance assistance to potential source facilities, and pursuing enforcement actions for violations of regulations and permit requirements. Latest actions and information • Residents continue to use Orange County’s online reporting form to submit odor complaints. Between August 24 and October 1, 2020, the County received 40 complaints concerning objectionable odors. More Odor Complaints and Orange County Needs to Fix Their Reporting Site

You'd think we'd get a day of relief around here but apparently, it wasn't meant to be.  The odor of today is one of the fetid fecal variety.  Today's complaints: -  At the gas station at 441 & Sadler. Horrible sewer/poop smell. While I was pumping gas, another customer, not from this area, asked me if I could smell the smell. I briefly explained the issue. . (Smell successfully submitted to OC and FDEP reporting sites.) - Tried to report the smell to the county, the website still not working! Sending an email to Maria Repass of Orange County EPD. [ maria.repass@ocfl.net] - I had that problem yesterday. - I wrote yesterday and will continue to write every time it doesn't work.   -  It let me get all the way to the end before it dropped which was happening before and I did not realize it wasn't working -    That's exactly what it did to me. - Horrible poop smell! September 4, 2020 Odor Update and Why We Need Weather Details to Report

Good morning, It's been a while since I've posted on here so it's time for an update.  Orange County's odor reporting site is acting glitchy and kicking people off. It's weird, sometimes it works and sometimes not. Maria Repass of Orange County is checking into it. In the meantime, send her an e-mail at maria.repass@ocfl.net. FDEP's odor reporting site is working fine.  All of the odors reported recently are of the "poopy" variety according to the information I have. Anuvia is still closed. I sent an e-mail to Ashley Gardner recently asking her to let us know when they plan to reopen. Anuvia has to give them a 30-day notice to allow for inspections before they reopen.  Recent messages posted in the Facebook group include: Poopy sewer smell. Smelt that funk at 7:45 am, to funkin' funky. Terrible Manure smell at 8am when I woke up in Stoneybrook Hills I was awakened from a dead sleep this morning by a horrendous odor. Updates on Anuvia- Increased Production Planned

The air in Tangerine and the surrounding neighborhoods have been free, for the most part, of the stink of Anuvia since mid-June. We can't rest too easy though, because Anuvia has plans to sell a lot of fertilizer in the future.  The latest update on Anuvia from the Orange County Environmental Protection Department indicated that they had been shut down since June 3, 2020. Anuvia has stated in the past they plan to ramp up production in the fall for the Spring 2021 planting season.  According to Total Landscape Care , Anuvia hired a new vice-president to " lead Anuvia’s efforts to build existing retail and distribution alliances while seeking to create new customer partnerships to further advance the sales of SymTRX, Anuvia’s bio-based, sustainable fertilizer." The Shelley Hearing was basically four hearings combined into two. The first three were combined at the request of Jonathan Huels, the Shelley family attorney. The last one was handled by itself. GPITA's function is either a fertilizer storage area or a chipping/composting area for Shelleys and is located further down the road on Jones Avenue. I'm sure that those who weren't able to virtually attend the Code Enforcement for Shelley's Septic Tank are wondering how it went. Long story short, Orange Coun ty Code Enforcement prevailed with the Special Magistrate. Shelley's filed a suit against the County on June 24th, 2020. It's Not Too Late to Send a Letter RE: Shelley Hearing

I talked to Rose Kelley at Code Enforcement today and, although they would have liked to have all input for the hearing 24 hours in advance, you can still send a letter for the hearing.  The e-mail address is coderesearch@ocfl.net. Please include your address in your e-mail.  You don't have to speak to write a letter.  The hearing starts at 9 am tomorrow. The agenda is below and the Shelley's are the first four items on the agenda. This post contains letters from interested citizens regarding the Orange County Code Enforcement Hearing for Shelley's Septic Tanks on July 8, 2020, at 9 am. The meeting is being held virtually due to Covid-19.  Dear Magistrate, I'm going to share my opinion regarding Shelley's Septic Tanks and the associated businesses. The stench of human waste wafts over my yard from time to time, particularly on Sunday evenings and holidays. I have concerns regarding Shelley's Septic Tanks poor business practices.
