Good afternoon,

I am writing to provide you an update on the Department’s enforcement cases with Shelley’s, Anuvia, and Monterey Mushroom. I appreciate you all continuing to use the online reporting tool, as that has assisted us in determining the source of the odors and where to send our inspectors.

Shelley’s update:
The Department entered into a consent order with Shelley’s on May 14, 2020. The corrective actions are outlined in the document, which is legally enforceable if they do not adhere to it. I have attached that document for your convenience. Please continue to report any odor issues using the online reporting form and the Department will continue to respond accordingly.

Anuvia update:
As stated in our previous update, the Department sent a draft consent order to Anuvia for their review. Both Orange County Environmental Protection (EPD) and DEP have open enforcement actions against the facility. Anuvia requested that the Department coordinate with EPD to combine their enforcement actions with ours. In hopes that we could make the process more efficient, and clearly define each agency’s regulatory authority, DEP provided a draft consent order to EPD for their review on April 14, 2020. Orange County returned the document with their edits on May 7, 2020. While this delay is extremely unfortunate, we are working as quickly and efficiently as possible to move this case forward together. The second draft consent order is currently being reviewed by DEP and EPD staff and will be sent to Anuvia as soon as possible. Throughout the process, we have been in communication with Anuvia. To date they’ve made the following improvements:
  • Determine the air stream pH to the biofilter and make adjustments to increase the efficiency of the biofilter.
  • Studied the water flow through the cooling tower and identified some areas where improvements could be made.
  • The pH adjustment and better cooling tower efficiency should help the performance of the biofilter.  Currently running tests to verify.

We are hopeful that this consent order will be executed in the near future.

Monterey Mushroom update:
The Department believes several of the odor complaints we received stemmed from this facility. However, the odors are associated with an agricultural process and have been referred to the Department of Agriculture and Consumer Services.

We are now able to report odors to the FDEP online. We still need to send an e-mail or call Orange County to report to them. Orange County is working on having an online system to report and it was supposed to be up this week. The virus is slowing things down.
